AURUMCOACH

These Terms of Service ("Terms") govern your use of AURUMCOACH (the "Platform"), operated by Solid Gold Performance ("we", "us"). By creating an account or using the Platform you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Who can use AURUMCOACH

You must be at least 18 years old, or have parental/guardian consent if you are between 13 and 17. The Platform is intended for residents of the Republic of South Africa. By signing up, you confirm that the information you provide is accurate and that you will keep it up to date.

2. Account types

Coach — a personal trainer or fitness professional offering services to clients via the Platform. Coach access is granted at our discretion after review of an application.
Client — a person who books sessions, classes or purchases programs from a Coach via the Platform.
Admin — Solid Gold Performance, which operates and moderates the Platform.

3. Coach obligations

Coaches are independent service providers, not employees of Solid Gold Performance. Each Coach is solely responsible for:

Their qualifications, certifications, insurance and tax compliance
The quality, safety and legality of the services they deliver
Any health-related claims, programming or advice they provide
Compliance with the Health Professions Act and any other applicable regulation
Honouring scheduled sessions and refund policies as published

We reserve the right to suspend or terminate any Coach account that breaches these Terms or harms clients.

4. Client obligations

You acknowledge that exercise carries inherent risk. Consult a medical professional before starting any new training program.
You confirm that information disclosed in any health assessment is accurate to the best of your knowledge.
You are responsible for paying for sessions, classes and products you purchase. Late or non-payment may result in suspension of services.

5. Payments and fees

Payments are processed via Yoco or another regulated payment service provider. You authorise us to charge the payment method you provide for the services you purchase.

1-on-1 sessions: Coach sets the rate. Solid Gold Performance retains 2% as a platform processing fee.
Group classes: Coach sets the rate per spot. Solid Gold Performance retains 15% as a platform fee.
Marketplace products: Coach sets the price. Solid Gold Performance retains 25%, paid out monthly.
Subscription tiers (where applicable): coaches may choose a paid subscription with reduced fees or additional features. Pricing is shown at signup.

All amounts are in South African Rand (ZAR) and inclusive of VAT where applicable.

6. Refunds and cancellations

Refund and cancellation rights are set out in our Refund Policy, which forms part of these Terms.

7. Intellectual property

You retain ownership of any content you upload (programs, photos, messages). By uploading content, you grant us a limited licence to host, display and transmit it solely for the purpose of operating the Platform. We retain ownership of the Platform itself, including its software, branding and any AI-generated outputs.

You may not scrape, reverse-engineer or resell the Platform or its data.

8. Privacy and data protection

We process personal information in accordance with the Protection of Personal Information Act (POPIA). Our Privacy Policy sets out what we collect, why, and your rights as a data subject. By using the Platform you consent to the processing described there.

9. Acceptable use

You may not use the Platform to:

Engage in unlawful, harmful, harassing or fraudulent activity
Impersonate any person or misrepresent your affiliation
Upload viruses, malware or content that infringes third-party rights
Send unsolicited commercial communications to other users
Attempt to gain unauthorised access to other accounts or systems

10. Liability

The Platform is provided "as is" without warranties beyond those required by the Consumer Protection Act. To the maximum extent permitted by law, our liability to you arising from your use of the Platform is limited to the fees you have paid us in the 12 months preceding the claim.

Coaches alone are responsible for the services they deliver. Solid Gold Performance is not liable for injury, loss or damage arising from a Coach's training services.

11. Termination

You may close your account at any time by contacting support@aurumcoach.co.za. We may suspend or terminate your account if you breach these Terms, fail to pay amounts due, or for any other reason at our reasonable discretion. On termination, your data will be retained or deleted in line with our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 14 days before they take effect. Continued use of the Platform after that date constitutes acceptance.

13. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of South Africa. Any dispute will first be addressed via good-faith negotiation. If unresolved, it will be referred to mediation under the Arbitration Foundation of Southern Africa (AFSA) rules and, failing that, to the South African courts of competent jurisdiction.
